At the FCC’s July Open Meeting, the agency voted to approve a Notice of Proposed Rulemaking (NPRM), which seeks feedback on actions to accelerate deployment within “multiple tenant environments” (MTEs) – apartments, condominiums, and office buildings.
WIA is monitoring this because it could lead to regulation of rooftop access agreements and DAS providers. WIA intends to inform the FCC about the benefits that can come from DAS deployments on MTEs and plans to emphasize how this is a solution that helps promote broadband adoption.
The NPRM seeks comments from authorities on which the FCC can rely to take action on revenue sharing agreements, rooftop exclusivity agreements (e.g. DAS), exclusive wiring and marketing arrangements, other contractual provisions and practices, and State and Local policies and regulations.
